EVIDENCE

— Evidence — Scope — Mere relationship with the deceased by itself does not affect credibility of eye-witnesses. [2024 CCJ 33 = 2024 PCrLJ 343]

— Interested witness — Scope — It is not a rule of universal application that a disinterested or independent witness will always tell the whole truth and a related or interested witness will utter only lies before the Court — When the Court is satisfied that a witness, though related to deceased or interested in conviction of accused, has told the truth then his testimony should be accepted without any hesitation. [2024 CCJ 25 = 2024 PCrLJ 229]

— Mere report is not conclusive unless the allegation is supported with other evidence after inquiry into the matter. [2024 CLS 19 = 2024 CLC 164 = 2022 LHC 6389]

— Cases in courts are decided on the preponderance of evidence led in the case by the parties, and in order to reach a just and proper conclusion, the oral as well as the documentary evidence shall be considered. [2024 SCLR 30 = 2024 SCMR 164 = 2023 SCP 350]

— Circumstantial evidence — Scope — Circumstantial evidence is sufficient when it enables the Court to make reasonable inferences about the ultimate facts in issue; it must be more than mere conjecture, speculation, or guess. [PLR 2024 SC 2 = PLD 2024 SC 45 = 2023 SCP 365]

— Documentary evidence — Scope — The document, which has not been brought on record through witnesses and has not been exhibited, cannot be taken into consideration by the Court. [2024 CLS 1 = 2024 CLC 1 = 2023 LHC 3306]
