GIFT
— Where donor at the time of preparation and registration of the gift deed was not available in Pakistan, Supreme Court observed that no question of acceptance and offer of gift as well as delivery of possession arose in favour of donee. [2024 SCLR 41 = 2024 SCMR 24]
— The pre-requisites of a valid gift are: (i) offer by the donor; (ii) its acceptance by the donee; and (iii) the delivery of possession — A valid gift comes into existence as soon as the three ingredients are completed — Any Muslim can make a valid gift of movable or immovable property orally, however, it may be reduced into writing as proof. — Revocation of gift — Scope — The pre-condition for revocation of a gift is that it can only be revoked before delivery of possession — It implies that despite declaration of gift by the donor and its acceptance by the donee, the donor may change its mind and may not complete the gift by not delivering the possession. [2023 SCLR 55 = 2023 SCP 271 = 2023 SCMR 2012]
